TERMS

A 50% deposit is required by EKLA HOME on all orders, and balance is to be paid before shipping..

New orders will not be scheduled into production until a 50% deposit is received. For orders over $50,000 NET a bank letter of credit may be required.

ORDER

All orders are subject to acceptance by EKLA HOME. Receipt of EKLA HOME acknowledgment indicates acceptance of your order subject to EKLA HOME conditions. Please read the acknowledgment carefully and notify us immediately of any discrepancies.

CHANGE ORDER

Requests for changes to orders must be made in writing. EKLA HOME reserves the right to charge for labor, materials and administrative costs for order changes.

CANCELLATION

Orders may not be terminated without EKLA HOME consent. Cancellation cannot be accepted after fabric has been cut, order is in production or materials have been placed on an order.

MERCHANDISE RETURNS POLICY

A written Return Authorization (RA) Form must be issued by EKLA HOME prior to the return of any merchandise. Unauthorized returns will be refused by our receiving department. Return merchandise must be received in original and saleable condition.

The customer is responsible for a 35% restocking fee plus freight should a return be authorized by EKLA HOME for reasons other than damaged or defective merchandise. The liability for any defective merchandise shall be limited to the replacement or repair of the merchandise at the option of EKLA HOME and EKLA HOME shall not be liable for any other damages or losses.

DELIVERY

EKLA HOME is not liable for delay or failure to deliver due to strikes, lockouts or other labor difficulties, failure or delay at other sources of supply, transportation difficulties, accidents, fire, war, riot, compliance with government regulations, acts of God or other causes of like or unlike nature beyond EKLA HOME control. Normal completion of orders is 4 to 5 weeks from receipt of COM/COL.

EKLA HOME will not accept any fabric freight collect. All fabrics should be clearly identified with the sidemark denoting the designer, dealer and/or client’s name and the purchase order number. Every attempt will be made to contact the appropriate person when fabric has been received containing inadequate information.

STORAGE

EKLA HOME does not have storage space for completed orders. If a customer is unable to accept delivery of merchandise when ready for shipment, EKLA HOME may transfer the merchandise to storage. All costs associated with storage, including transportation, will be charged to the customer. EKLA HOME will consider such shipments as “delivery to the customer” and all other Terms and Conditions should apply. Customers will bear all risks of damage or loss during storage of merchandise.

CLAIMS

EKLA HOME is not responsible for damage in transit or storage. Customer must examine merchandise upon receipt and note any obvious damage on carrier’s delivery receipt Any claims against EKLA HOME for defects, errors or shortages must be made within ten days of delivery. Failure to make any such claims shall constitute full acceptance of merchandise.

WARRANTY

EKLA HOME warrants its lounge seating frames to be free from defects in materials and workmanship for a period of five years from date of delivery. During the warranty period EKLA HOME will repair or at its option, replace free of charge, products that are proven to be defective. This warranty does not apply to damage resulting from accident, alteration, misuse, tampering, negligence or abuse. Wood furniture is made of naturally variable raw materials. Differences in grain characteristics and color among wood species are naturally occurring variations and are not within the control of EKLA HOME nor considered defects included in this warranty. COM Textiles and COL Leathers are not warranted.
